Intellectual property law is the law that deals with trademarks and patents that provide exclusive rights to those who create something that is a creation of the mind. Under this law, owners of such properties, known as intellectual properties, are given exclusive rights of ownership on such creations which could include a gamut of activities ranging from musical to literary to artistic discoveries or inventions. They also include designs, symbols, phrases or even words. Trademarks, patents, copyrights etc. are some of the common types of intellectual property rights conferred on the owners by the Intellectual Property Law.

Logos and trademarks

For any brand to make its presence felt and for it to be visible and noticeable, it is important to have a logo for itself. A logo can be a modest simple design or an elaborate and complex design; but it needs to be unique. A logo needs to convey the importance and the uniqueness of the brand and the product. It is for this reason, that it is important to register your logo as a trademark, an act that gives you legal standing to bring an action against someone who is looking to steal or copy your logo or design.

Trademarks and Company Names

Just like logos and logo designs define your product or company, your company name is unique only to you. It is nobody else’s to own or take advantage of. Therefore, just as it is important to register logo as trademark, it is also important to register your company name with the authorities so as to have legal standing in case you are ever required to bring legal action against someone. When you obtain a trademark for a company name, you get more legal rights than someone who merely has a company name, but not a registered trademark. It is important to note that, when you just have a trademark you can use the letter TM after the company name or logo; but once you have registered the trademark, you are allowed to use the letter R embedded in a circle or the word Red. to be used after the company name or logo. Needless to say, a registered trademark has more legal standing than a nonregistered one.

International trademarks

Merely registering a trademark for a company name is not enough, it should hold good, preferably internationally as well. For this your trademark needs to be registered with the International Trademark Association as well.
