Second, one may apply for a Community Trademark, by which one may secure trademark protection in all 27 EU Member States with one single trademark application.

If you apply for trademark registration and your trade name is registered, you will have the right to use the distinctive ® symbol in connection with your trade name registration. Trademark registration places the public on notice of such rights and whether innocently or by intent others may be enjoined to infringe on the exclusive right to use the registered trademark. The owner may in such cases be entitled to recover profits and damages.
