To avoid a trial when feasible, that is why many litigators rely on other strategies and methods. Providing justice at an agreed upon level without undergoing the rigors of a trial, a common option, of course, is to negotiate an out-of-court settlement.
The process is unscientific, unpredictable, and at times unprofessional, while some attorneys are better than others at negotiating an out-of-court settlement. Arbitration and mediation are the most common procedures. Briefly, with the help of a neutral third party, mediation or conciliation provides a forum in which parties can resolve their disputes. To solve their own problems, mediation depends upon the commitment of the disputants. Keeping both parties talking until an agreement is reached, the mediator never imposes a decision.
After hearing the evidence and arguments, imposes a binding decision that is enforceable by the courts, arbitration involves use of a neutral third party. To live by the arbitrator's decision and both parties ahead of time agree upon who will be the arbitrator, the disputing parties agree ahead of time.
