Dirty Dui – Very Dirty Divorce!

The Oakland Tribune reported on July 31, 2011 what San Francisco Family Law Attorneys have suspected for many months. Life imitates tawdry fiction.

As unbelievable as it may sound, the Tribune reported the following:

A “regular guy” engineer, who was going through a nasty divorce and child custody/visitation dispute, met a striking blonde through an on-line dating service. He thought his luck was “too good to be true” and, as it turns out, he was right.

For their second date he met his new honey and a friend of hers at a bar where they kept plying him with drinks. They asked if he wanted to leave and join them in a hot tub and he readily agreed. Since they were in a two-seat convertible, he was obliged to follow them in his truck.

He hadn’t followed them very far when he saw he was being pulled over by law enforcement. He was arrested for drunk driving with a 0.12 blood alcohol content. Very bad news.

Not only was he forced to deal with the criminal implications of driving under the influence, his wife and her San Ramon, California divorce attorney used the event as leverage ...
... in his divorce action to limit his visitation with his children.

The kicker in this sad story is that the whole thing was a trap.

It turns out that an on-going investigation into police corruption has revealed that the arresting officer was tipped off that the love-struck divorcee would be driving by a former police officer, now private detective, hired by his ex-wife and her attorney. And, of course, the temptress blonde and her friend were also in the employ of the private detective.

As despicable as this sordid little story may seem, the truly contemptible fact is that the suspect private detective told a District Attorney investigator that there is another divorcing dad who was set up in the same way by another client of the very same family law attorney.

Incredible.

At this time, the State Bar of California says that there are no charges pending against the, so-called, family law attorney named in the investigation. The Bar also says that any investigation they may be doing is, at this point, confidential. Hopefully, if these allegations are true, this person will soon lose her license to practice law in California.

Family law attorneys are generally not stooping to this egregious level of conduct. However, a contested divorce is a lawsuit and a family law attorney will exploit any misfortune of the opposing party to the advantage of her client. Welcome to hard-ball divorce litigation.

Far and away the best way to avoid the sort of extreme behavior associated with battling husbands and wives is to circumvent the battle! No one should be suing their spouse. It is so much better for all concerned to engage in the supported conversation that is mediation and together forge an agreement to dissolve the marriage on agreeable terms and conditions.

Mediation works, even where there is conflict. Every husband and wife that wants to end their marriage should make it their first avenue of approach.
