Before knowing the difference between the DUI and DWI and offences one needs to know what does each of these acronyms means. DUI is nothing but driving under the influence and DWI stands for driving while intoxicated. Most often these terminologies are mistaken to be the same but there is a significant difference between the two offences and they are as follows:

The first major difference is that DWI is a much more serious offence, as you will be charged of driving under the influence of alcohol that exceeds the BAC (blood alcohol consumption) limit of .08 at the time of the test. Whereas, in a DUI case you will be charged of drunken driving but here technically the BAC level will be lower rather lesser than the legal limit.
In states such as New Hampshire, if convicted of DWI then your driver license is suspended. If it is aggravated or a second offense or more, you will be taken to jail. All drunk driving convictions are misdemeanors or felonies, so you will have a criminal So depending on various state laws the severity of the offences too vary.
The other difference different states or jurisdictions classify ...
... the two offences separately and usually DUI is considered a lesser charge. But a few states in the US follow zero tolerance policy, where there is no difference between the two; DUI and DWI, the laws in such states makes it mandatory to charge if an individual’s BAC exceeds the legal limit.
A few states in US categorize DUI as driving under the influence of drugs and DWI is charged as alcohol impaired driver.

With more and more reports of drunken drivers the law will eventually get tougher no matter in which state you live and the difference between DUI and DWI will soon shrink and the offences will be taken more seriously.
It pays to know about good DUI and DWI defense attorneys although the best way to stay away from legal hassles is to be one responsible citizen and drive safely without mixing driving with drinks or drugs. With holiday season drawing close, stay safe and away from drugs.
