A Working Day Like No Other Is In Store For The Charity Law Professional
Charities are no longer all about the simple act of donating money with the knowledge that those funds are going to be used for something worthy and beneficial.
The donation procedure may seem easy as it simply consists of the organisation in question collecting the funds and disbursing the money to the areas that need it.
Yet, this isn't the case as charity solicitors are well aware.
As with any kind organisation, charities are governed by specific laws and regulations. One such law makes it a crime for the donation recipient to use the funds for something other than what the money was intended.
Because there are so many instances of fraud occurring in the charity sector, the field of charity law has come about as one for lawyers to add onto their growing list of practice specialties.
What do charity lawyers do on a daily basis?
Those who practice charity law ...
... are exposed to many types of cases, including but not limited to the following: putting together contracts between an established charity and another organisation looking to form a partnership or joint venture with the charity; employment issues centering around the maintenance of the staff that works on the charitable cause in some way; overseeing the reorganisation and restructuring of a charitable company to ensure that all applicable laws are followed; and finally, anything to do with the activity of fundraising for the charity in question.
Negotiating with the Charity Commission on behalf of a client to award the charity's trusteeship to a qualified individual is another common occurrence in the charity solicitor's working day.
Furthermore, the charity solicitor needs to keep their clients abreast of all pertinent news and law changes regarding charitable organisations and the manner in which they are governed.
A charity solicitor has a day unlike many of their counterparts working in the law. Although they deal with employment issues or company restructuring, it's the fundraising and money disbursement duties that make for an interesting day.
