Us Courts Consider Wider Guidance On Artificial Intelligence

The US federal judiciary is developing further guidance on how artificial intelligence should be used within the court system as judges and court staff increasingly encounter the technology.

A federal judiciary task force has prepared dozens of recommendations, with final guidance potentially coming by the end of 2026. Interim guidance issued previously makes an important distinction: AI should not be used for core judicial functions such as deciding cases, while administrative uses may offer practical benefits.

Some courts have already experimented with AI for operational tasks. The Fifth Circuit, for example, has offered an AI-based tool intended to assist attorneys with filing documents correctly.

The risks are also becoming clearer. Earlier incidents involved court staff using AI that produced false or incorrect case citations. Courts have also dealt with AI-generated material submitted by lawyers and self-represented litigants, with disciplinary action taken in some cases.

Possible changes to procedural rules may eventually address how litigants use AI. Any recommendations from the task force would still need to pass through the judiciary’s formal processes before implementation.

The debate is therefore moving beyond whether courts will use AI and toward where its use is appropriate and compatible with judicial decision-making.
