Although this story has been told again and again, it is not the only legend of how coffee was discovered: Left to die in the desert, a banished Arabian man and his followers desperately seek sustenance to sustain themselves. An unknown berry soon became their lifeline and its broth they named Mocha. No matter which legend you believe, one thing is for sure, few inventions in history have had such an enormous impact throughout the world. For many, it's hard to imagine even getting out the door in the morning let alone going to work without their cup of "jo". So how exactly did we get so hooked on this beverage? The first actual coffee maker was produced in 575 A.D. by the Turks. In 1818, the coffee percolator made the beverage even more popular. Although they were big among some crowds like cowboys, coffee grounds were messy and not everyone wanted to deal with them. It wasn't until 1912 when paper filters were introduced and cleanups became a breeze, that the greater potential of this product began to be realized. By 1972, Mr Coffee(r) introduced the automatic drip process. The product was so successful, that it still remains the most popular automatic coffee maker even today. Over the years, coffee has made the transition from being a simple energy drink to an integral part of how we live our lives. Coffee is both a part of our social experiences as well as an accepted norm for doing business. While side effects include everything from bad breath and discolored teeth to hyperactive behavior, somehow it remains a necessary evil for getting through the day. Coffee has now become so popular, that coffee shops are the fastest growing part of the restaurant business. In milieuvergunningprocedures geldt dat, naar aanleiding van een ingediende aanvraag, in eerste instantie een ontwerp-besluit wordt genomen en bekend wordt gemaakt. Dat ontwerp-besluit wordt gedurende zes weken ter inzage gelegd en in die termijn kunnen belanghebbenden die het niet eens zijn met het ontwerp-besluit, een zienswijze indienen. Vervolgens wordt dan een definitief besluit genomen, waarbij ook wordt ingegaan op de zienswijzen. Tegen dat definitieve besluit kan beroep worden ingesteld bij de Raad van State. Tot voor kort gold dat in de beroepsprocedure enkel kon worden geklaagd over aspecten die ook al in de zienswijze zijn genoemd. Werden nieuwe aspecten in beroep aan de orde gesteld, dan leidde dat tot niet-ontvankelijkverklaring, hetgeen er op neerkomt dat de Raad van State zich over die beroepsgrond niet uitspreekt. De hiervoor bedoelde algemene regel is door de Raad van State in een uitspraak van 27 januari 2010 iets bijgesteld. In die uitspraak geeft de Raad van State aan dat de beperking dat in beroep enkel kan worden geklaagd over de aspecten die ook in de zienswijze aan de orde zijn gesteld, beperkt blijft tot “beslissingen over de aanvaardbaarheid van verschillende categorieën milieugevolgen”. Onder verschillende categorieën milieugevolgen wordt o.a. verstaan: geur, geluid, trilling en ammoniakemissie. Voor al die aspecten geldt derhalve nog steeds dat daarover in beroep enkel kan worden geklaagd, indien de aspecten in de zienswijze zijn genoemd. Wordt echter in beroep bijvoorbeeld gesteld dat het verlenen van de milieuvergunning leidt tot strijdigheid met het bestemmingsplan (een mogelijke weigeringsgrond ingevolge artikel 8.10 van de Wet milieubeheer) dan moet de Raad van State zich daarover uitspreken, ook al is dat aspect niet in de zienswijze genoemd. Een ander voorbeeld is dat in het beroepschrift wordt gesteld dat geen revisievergunning had moeten worden verleend, maar een oprichtingsvergunning. Ook dat aspect mag dus voor het eerst in beroep aan de orde worden gesteld. De uitspraak van 27 januari 2010 maakt niet duidelijk of in beroep met succes kan worden geklaagd over bijvoorbeeld strijdigheid met het bestemmingsplan, indien in het geheel geen zienswijze over het ontwerp-besluit is ingediend. Is in het geheel geen zienswijze ingediend en wordt in het beroepschrift enkel geklaagd over strijdigheid met het bestemmingsplan, dan zou mogelijk dat beroep toch ontvankelijk kunnen zijn. Toekomstige rechtspraak zal dat duidelijk moeten maken. Vooralsnog lijkt het er echter op dat het indienen van een zienswijze noodzakelijk is om een ontvankelijk beroepschrift te kunnen indienen. Stel, u gaat uit elkaar en u heeft minderjarige kinderen, dan doet u er verstandig aan een ouderschapsplan op te stellen. Indien u getrouwd bent, een geregistreerd partnerschap bent aangegaan of samenwoont en het gezamenlijk gezag heeft over uw minderjarige kinderen, bent u op grond van de wet zelfs verplicht een ouderschapsplan op te stellen. Wat is een ouderschapsplan? Dit is een schriftelijke overeenkomst die ondertekend moet worden door u als ouders. In deze overeenkomst moeten afspraken worden gemaakt over de kinderen. Als ouder heeft u een grote mate van vrijheid over de wijze waarop u het ouderschapsplan opstelt, maar u dient in ieder geval afspraken te maken over de volgende zaken: - de manier waarop u als ouders de zorg- en opvoedingstaken verdeelt. U moet dan denken aan het verblijf van de kinderen, de tijd die de kinderen met beide ouders doorbrengen (de omgang) en welke taken u als ouders op zich neemt; - de manier waarop u als ouders elkaar raadpleegt en informeert over belangrijke aangelegenheden, die de kinderen aangaan, zoals school, vermogen en gezondheid; - de kosten van verzorging en opvoeding van uw kinderen (kinderalimentatie). Ook moet worden vermeld de wijze waarop u als ouders uw kinderen heeft betrokken bij het opstellen van het ouderschapsplan. Het hangt van de leeftijd van uw kinderen af in welke mate u de kinderen hierin dient te betrekken. Van belang is dat u in ieder geval samen de kinderen uitleg geeft over de afspraken die u heeft gemaakt. In het verzoekschrift tot echtscheiding dient de advocaat eveneens te vermelden over welke punten u het eens bent geworden en over welke punten niet. Wat kunt u als ouders doen als u het niet eens kunt worden? Uw advocaat dient in dat geval in het verzoekschrift tot echtscheiding aan te geven waarom u als ouders er niet in bent geslaagd in overleg een ouderschapsplan op te stellen. Een rechter zal in de regel genoegen nemen met een concept echtscheidingsplan dat door één ouder is opgesteld, indien het onmogelijk is gebleken afspraken te maken. U dient er wel rekening mee te houden dat een rechter u vervolgens naar een bemiddelaar verwijst met als doel om alsnog te proberen afspraken te maken over uw kinderen. Met de invoering van de Wet bevordering voortgezet ouderschap en zorgvuldige scheiding op 1 maart 2009, waarin het ouderschapsplan is geregeld, wordt bevorderd dat u als ouders nadenkt over de invulling van het ouderschap na de scheiding. U dient hierover goede afspraken te maken om onnodige conflicten in de toekomst te voorkomen. Er wordt vanuit gegaan dat na scheiding het ouderschap wordt voortgezet. U blijft als ouders samen verantwoordelijk voor de verzorging, opvoeding en ontwikkeling van uw kinderen. Beoogd wordt de band tussen de kinderen en beide ouders na scheiding te behouden. Kortom, u gaat als partners uit elkaar, maar blijft na echtscheiding samen als ouders verantwoordelijk voor uw kinderen. Het ouderschap blijft voortbestaan.
