A Qualified Domestic Relations Order is nothing, but a document that splits the retirement account of an investor with his dependant, spouse or ex-spouse. In most of the cases, it is used during divorces. The term ‘qualified’ is present in the order just because of the fact that it is applicable only to assets held in the retirement plans like the traditional pension plans, IRAs, 403(b)s, 401(k)s that are qualified for special tax treatment under the Employee Retirement Income Security Act 1974.

In effect, a QDRO permits money inside such plans to be distributed to another owner without facing the penalties and taxes that an early distribution would generally face. Now, let us get into the details about the working of this order:

This order is generally issued by the state agency or court that can issue verdicts under the domestic relations law of the state. The rules of original plan must be followed by the order and it cannot announce any increase in the benefits of the original plan. For maintenance of the tax-deferred status of the original account or in the event of Roth, the distribution must be transferred ...
... into another retirement plan that is qualified in nature. In addition to the accounts like that of 401K that has an asset value, but do not possess any guaranteed payout, the order can also divide confirmed income flows from traditional pensions.

What is required in a QDRO? The Qualified Domestic Relations Order must include the original owner’s full name, the last known mailing address and the name of the person, who will be receiving the benefits thereof. Also, it should have the social security number of both the parties involved, the identification number of the plan and its formal name and the amount to be paid to the new owner. In the case of a pension, it should have details about the time available for payment of benefits to the new owner.

An individual, who is under 401K Divorce case, can get the help of an attorney specialized in QDRO law. Here, it would be wise to get the help of a local lawyer because of the fact that the professional will be aware of the local laws and will move the things accordingly. The professional can also guide the individual with respect to the items to be included in the 401K divorce case so that he can protect himself from the distribution of assets acquired before the actual date of the wedding.
