What is a domestic relations order?- It can be either a court judgment or a court order or decree in accordance with the prevailing laws for family relations. This type of court orders is mostly related to the protection of child, alimony, rights of the spouse on marital property, rights of an ex spouse, and child. However, it must be preceded by a judgment from a court or an equivalent authority so as to formally approve the settlement agreement. A mutual settlement agreement among the parties concerned is not sufficient. Also it is not a must that the parties concerned have to endorse the order. When a domestic relations order identifies an individual as an alternate beneficiary to receive a part or all of the participant’s benefit it becomes a Qualified Domestic Relations Order (QDRO).
