Know About Dro And Qdro
What is a domestic relations order?- It can be either a court judgment or a court order or decree in accordance with the prevailing laws for family relations. This type of court orders is mostly related to the protection of child, alimony, rights of the spouse on marital property, rights of an ex spouse, and child. However, it must be preceded by a judgment from a court or an equivalent authority so as to formally approve the settlement agreement. A mutual settlement agreement among the parties concerned is not sufficient. Also it is not a must that the parties concerned have to endorse the order. When a domestic relations order identifies an individual as an alternate beneficiary to receive a part or all of the participant’s benefit it becomes a Qualified Domestic Relations Order (QDRO). Nobody other than a spouse, ex-spouse, child or other dependant of the participant can become the alternate payee.
A QDRO will exist and be treated as valid even if it issued after the death of the participant, after a legal divorce, after commencement of the annuity or subsequent to an earlier QDRO. Hence the timing of issuing the ...
... QDRO cannot be a reason for it to become void. In case the alternate payee is not eligible to receive the benefits at that time because of his age or any other genuine reasons, the payment can be made to somebody who will have the legal responsibility to hand over the same to the actual beneficiary at an appropriate time. He can be a guardian or a trustee.
In the case of a divorce, the QDRO must be a part of the divorce agreement. This will help the to-be separated spouse to have a legal right to a fixed percentage of the account balance or the retirement benefits. The alternate payee who gets the legal right for part of the benefits of his or her ex-spouse will be liable to pay the income tax for the amount received.
Those who search for the answer to the question “what is a domestic relations order?” should also learn about QDRO. Everyone must be aware of the fact that if a part of one’s retirement benefits go to the ex-spouse without a QDRO the recipient will not be liable to pay income tax for that amount. For the recipient it is a tax-free income and the person from whose accounts the payment was made will be liable to pay the income tax for that amount also. In addition, penalties for pre-mature withdrawal also are imposed.
