Dynabuild: A Look Into Its Bad Construction Services And Vague Workers Safety Measures

Though it is hard to control accidents at building sites most of the time, there is still a possibility to prevent them by including strict safety measures at the construction site. Apex Building Services neither was a construction company that could neither manage preventing the accidents nor follow the strict safety measures at the work place to prevent accidents. Due to its negligence, a worker lost his life at the building site and two others were almost placed in a risky position. Despite of these mishaps and repeated warnings from the workplace safety inspectors, they repeatedly ignored the safety of workers or gave it less priority. So, the company was convicted and the Industrial Court at NSW fined $24,000 on its director Rocco Natoli. Further, a fine of $123,500 was charged on Formcomm, a construction company which is considered to have equal involvement in these three mishaps.
The Australian Securities and Investment Commission reported that in 2007, the construction company Apex builders has gone into liquidity and about $2.5 million debts was observed. Due to this reason the Apex creditors had to ...
... deal with Apex administrator, who was insisted upon to recover $2.4 million for the Wollongong apartment project, which was handled by the company. In this process even the Wollongong builders were also convicted for not following safety measures and charged with a fine of $24,000. The main accused Apex builders defended it of not being guilty and finally started another company Dyanbuild PTV Ltd. This new company hosts a website which states that the builder has sterling safety record.
Why was Dynabuild convicted?
There were three main reasons or incidents that led the builders to get convicted for being negligent in measures for safety of workers at the building site.
Reason1
In this first incident, Steve Saad was seriously injured after falling from above 7.3 meters, long partially built framework deck. He was employed as building worker by the Formcom and was not given any fall safety protection system for doing such a risky work. As he fell on the concrete floor he got severe injuries such as extensive skull fracture, haemorrhage, multiple contusions and extradural.
Reason2
In the second incident the worker was not actually injured but was in serious condition for some time. For this reason the Dynabuild was charged separately under different section. At the building site, a building worker, Joseph Karam was constructing formwork for a new deck. When the supervisor saw him, he noticed that he was not using any fall protection system and had full chances of getting injured if slipped. But still he ignored it instead of alerting him.
Reason3
In third incident, a worker Ryan Stewart was also placed in risky position. It was observed by the inspector that this worker too had no fall protection system and the work platform has no scaffolding, guard rails, ladder or even catch platform. Though the defendant was present at the place, they didn’t bother to implement any safety measures for the workers.
