Oregon Salvia Divinorum Laws & Legal Status
Salvia divinorum has been in use already for a long time. The Mazatec Shamans of Oaxaca Mexico employed it as an aid in divinization purposes. Aside from that, they also regarded it as the reincarnation of the Virgin Mary and used it for treatment of a variety of diseases. Because of that, the name “ska Maria pastora” and “Seer of the Sages” become the nickname of salvia divinorum. However, though the historical usage of the plant shows no signs of harmful effects or use, it is still placed on controlled substances by some of the countries and US states. Fortunately, salvia divinorum remains legal at Oregon. However, there is a pending bill that if passed, would put both salvia divinorum and salvinorin-A in Schedule 1 of controlled substance. If caught, the fine will be up to one year in prison or a fine of up to $6,250 or both. Manufacturing and delivering comes with heavier punishment, which include a maximum of 20 years in prison or a fine of $375,000 or both. However, like I said, it has not yet passed but may be possible to be effective.
Aside from that, there were bills that tried to be implemented earlier on March 15, 2003, which if passed, would implement a punishment of a maximum of 10 years in prison and a fine of $200,000 or both. Another bill on the same year was passed and it will serve a maximum of 20-year imprisonment or $300,000 fine or both if implemented. Fortunately, those two bills died in committee. Representative John Lim started the current pending bill on January 25, 2007 with a quote saying:
“From what I understand this drug is at least as dangerous as marijuana or LSD", and Seth Hatmaker, a spokesman for Lim—"I think it's only a matter of time before we find people addicted to this stuff”
Those statements does not have any sufficient evidence to be considered as true and it is clear that these persons does not know the true characteristics of salvia divinorum.
