Different countries and U.S. states have imposed different rules and restrictions regarding the use of salvia divinorum. Some U.S. states have banned it completely; some placed it into restrictions, other countries such as Australia also banned it but it remains legal in most parts of the world.

If you want to try out salvia divinorum, one of the things you need to keep in mind is to check whether it is legal or not in the place where you live. Failure in doing so can lead to serious criminal liabilities. In our case, we will talk about the legality of salvia divinorum in Texas and the laws that governs it.

Though several US states have already banned salvia, there is still a majority of them, in which it remains legal, and Texas is one of those states. You can think of yourself as one of the lucky folks because you still have the privilege to use salvia divinorum and bring it anywhere. But did the authorities really ignored the issue about this plant? Let us discuss about the several attempts to prohibit salvia divinorum and salvinorin-a at Texas.

The first attempt to ban salvia divinorum started on March ...
... 2, 2007 when Representative Charles “Doc” Anderson proposed to put salvia divinorum and salvinorin-a to Penalty Group 2. However, the bill died into the committee and never passed into an actual law. Aside from that, there are two other proposals on March 9, 2007. One of them proposed to place salvia divinorum and salvinorin-a to Penalty Group 3, which was introduced by Representative Tan Parker, and the other, which was proposed by Senator Craig Estes would make the sale of salvia to minors illegal, but salvinorin-a is not included. Just like the first one, those two died under the committee and never succeeded to be passed as an actual law. More than a year and a half later, on November 10, 2008 another two new proposals were started. Representative Charles “Doc” Anderson and Senator Craig Estes proposed their new bill. The first one wished to put salvia divinorum under Penalty Group 3, which was higher than his previous proposal which only falls under group 2, the latter proposed the same bill as his previous: to prohibit salvia to minors. However, until today, those bills have not yet been passed into an actual law and it seems that it will also die eventually.

To many salvia divinorum connoisseurs, laws proposing the prohibition of sale, use, distribution and consumption of it to minors is okay. Salvia divinorum is intended to be used only by persons with sober minds and adults with right wisdom and under good mental health. What salvia supporters hate about the bills and laws is the harsh treatment of it, which intends to place it under severe levels of the law. As of the true benefits of salvia divinorum, this plant is helpful if used properly. The only reason why it was being conceived as the infamous “sight inducer” is that people abuse it and sometimes use it only for pleasure, which is not right.
