Well drilling is governed by different bodies in each state. In New Mexico, it’s governed by the Office of the State Engineer. In Kansas, it’s regulated by the Kansas Department of Agriculture's Division of Water Resources.
New Mexico
Well drilling New Mexico is governed by the Office of the State Engineer to regulate well construction and abandonment. This body also governs the licensing of well drillers within the state. Any people who intend to drill water wells to appropriate water from any underground source within New Mexico's boundaries must file an application for a drilling license. It is illegal for any firm or person to drill water, or begin drilling a well, without a valid license issued by the State Engineer of New Mexico.

The Office of the State Engineer updated the regulations governing the licensing of well drillers on August 31, 2005. The updates included changes that deal with the following:
construction, repair, and plugging of water wells
continuing education requirements for drill rig supervisors and well drillers

Kansas
Kansas Drilling – The Water Appropriation Act
Water is a natural resource that is protected for the benefit and use of the citizens of Kansas. The Kansas Water Appropriation Act is a law governed by the Kansas Department of Agriculture's Division of Water Resources. It is in charge of issuing permits for Kansas drilling. It also regulates water usage and keeps records of all water rights within the state. The act is in place to protect the right of citizens to use water and the state's water supplies for both underground and surface water. It is unlawful for any person or corporation to drill a well without applying for and obtaining a permit to appropriate water from the division in charge of water resources. Violating the law carries a maximum of six months in jail and a $500.00 fine.
The exception to the rule in regard to Kansas drilling is for water intended to be used domestically, namely water used within the household, watering livestock, and/or water for up to two acres of garden or lawn. A permit is not required for that water usage class. However, farmers who use irrigation systems to grow crops are required to obtain a permit and to report yearly what the water was used for.
