Elder law can be complicated. Planning for your future after getting a diagnosis of Alzheimer's disease is frightening and difficult. There are tough decisions to be made and hard questions to ask. It's important to make sure that you have arranged for someone you trust to take care of your finances, other business, and medical decisions before Alzheimer's disease progresses, or else the courts may appoint someone who will make choices you would not approve.

An attorney experienced in elder law can be a helpful ally in your planning. They can ensure that you have the proper paperwork in order so that your wishes will be carried out. But how do you find one? What will they help you do? What information do you need to share with them? These questions and more will help you in your planning.

Q How can I find an elder law attorney to help in my planning?

You need an attorney experienced in elder law. A friend, family member, or co-worker may be able to recommend someone. If you have an attorney for other matters, they may know someone suitable also. Caregiver support groups or your local senior center may have ...
... ideas also. If you still can not find an attorney, contact your local bar association for a list to consider.

Q What kind of attorney should I be looking for?

When planning for Alzheimer's disease there are a lot of things that you will eventually need help with. You want to make sure that you arrange for someone to make medical decisions for you, and your personal beliefs and wishes are clear to them. You will need someone to handle your money and decide what should happen to your belongings. The planning may involve taxes, social seciruty, medicaid and health insurance, life insurance, pensions or retirement accounts, powers of attorney, trusts or conservatorships, medical decisions, and housing. An elder law specialist has experience in all of these fields.

Q What should I do before I meet with an elder law attorney?

Before your appointment, think about what you want. You need to have an idea of what health care decisions you want made for you, and who you trust to make sure your wishes are followed. Consider your assets and how you want your belongings to be distributed both before and after your death. Do you want to stay in your home? Is there a nursing home you would prefer if that becomes necessary? All of these things should be considered.

Q What should I bring to my consultation?

Your elder law attorney will need a list of your major assets and liabilities. Deeds, titles, loan papers, stock certificates, bank statements, and any other paperwork you have. If you have an existing will or power of attorney bring those also.

Alzheimer's robs you of your ability to make your own decisions. As soon as you get your diagnosis, contact an elder law attorney to help you make plans. If you prepare, you can be sure that your wishes will be respected and your future will be as close as possible to the way you wish.
