Family Lawyer And Importance Of Finding A Competent Person For Your Case
While searching for a standard Family lawyer the first thing to be considered is what exactly your needs are. The family law being an amalgamation of different streams like divorce, child custody, maintenance, etc one needs to go for someone who specializes in the subject or find a law firm which has a team of lawyers specializing in all the aspects of family law.
Firstly, the comfort levels have to be seen - whether you are comfortable with a male or a female lawyer the decision is yours to be made. If that part is decided, ask yourself if you would prefer someone who has a similar cultural background matching that of yours. Then decide on the age factor of the lawyer if you want someone who is about your own age group or if you think a senior counsel would be better suited for your case.
If you want to be part and parcel of the whole process ie, if you are well informed about your case and needs, and would like to be in charge of the case and if so you would be happy with a less experienced lawyer/solicitor/attorney who could be less expensive.
Now the most important part of the deal would be the professional ...
... standing of the lawyer. What would you prefer in your advocate? Should he be experienced in family/matrimonial law for divorce, a specialist or a general practitioner would do! A lawyer, who would be a counselor too who would be a good negotiator to get you an amicable settlement.
Professionalism would also mean that the lawyers who deal with family subjects have to be polite and understanding as the people coming to them would be passing through an emotional phase which has to be well received by the counsel. Confidentiality should also be part of a family lawyer’s professional ethics. A lawyer needs to keep up with the dates and events and update it to his or her clients.
If the dispute is acrimonious then you need an experienced lawyer who would be tough on your behalf if your needs are specific say birth injuries or trauma etc a lawyer with good exposure to such cases should be preferred.
The trickiest part would be make sure that he had not acted for both the partners any time in the past which would bring in conflicting interests. And finally it has to be verified whether he has an accreditation as a family lawyer under the resolution.
Though most people go for a lawyer through a reference or by the reputation that surrounds a leading lawyer there is no hard fast rules to follow. One has to also consider the financial aspects before engaging a family lawyer, what one expects to gain in form of financial settlements should not be lost in a costly legal affair.
To put it in a nutshell a family lawyer needs to be balanced not jumping in condemning the other party, one who would give practical advice and prepare you for every step, gently remind you if you are wrong when needed, be sympathetic without indulging in details, advise if counseling is required, be kind and reassuring with a degree of professional detachment without being aggressive in his approach.
