Firm Fined Over Worker Accident

When workers suffer physical harm as a result of the negligence of their employers, they often make personal injury claims and one man who may be doing precisely this is Barry Hill.

In August 2008, the 60-year-old was performing his role as a forklift driver at Palletways (UK) when he noticed that one of the cabinets he was moving was rocking. He got out of his vehicle to catch the object but it fell forward, hitting him on the head and knocking him to the ground.

As a result of the accident, he suffered a broken neck and right wrist and he has not returned to work since.

After the incident, Mr Hill was bleeding from a visible head wound but a trained first aider did not recognise the severity of his injuries. Therefore, nobody called an ambulance and instead the first aider drove Mr Hill by car to a hospital with no accident and emergency unit. From here he had to be airlifted to Heartlands Hospital, which is the flagship medical centre of the Heart of England NHS Foundation Trust.

Mr Hill, who may be making a personal injury compensation claim, spent six days in hospital and 14 weeks in halo traction ...
... and still has discomfort in his neck. He is now partially disabled.

Recently, Palletways (UK) pleaded guilty to breaching health and safety laws and was fined £60,000, as well as being ordered to pay costs.

In cases like this, is it not unusual for victims to make personal injury claims.

Meanwhile commenting on the incident, Health and Safety Executive (HSE) inspector Lyn Spooner said: "This was a preventable incident that could easily have resulted in death or paralysis. Each year, about 8,000 incidents involving lift trucks, often caused by poor operator training, are reported to HSE."

By making a personal injury compensation claim, workers can help to cover their expenses and they can experience a sense of retribution.
