You will then obtain the legal divorce papers from the online site and fill them out to the best of your ability and knowledge. If your spouse has abandoned you, the court will need to know their last known residence. If you have children, you will need to file a child custody form outlining exact visitation rights for each parent, as well as the expected amount of child support and the payment terms. The court in each state decides if the payment of child support goes through the juvenile court system or is handled individually between the two divorcing parties.
In the arena of spousal support, each state has a determining factor for who is allowed alimony. Sometimes, this is the same law for all of the state but it can vary from county to county. If you live in a separate property state, all of the goods and accounts owned by the individual parties before the divorce will be considered separate property and not touched by the other party.
