If you want to file for bankruptcy, you will need to complete a bankruptcy course and earn a bankruptcy education certificate. Legally, you are required to complete this course before your bankruptcy can be filed and completed.

Why a Bankruptcy Certificate?

Taking a bankruptcy course and earning a bankruptcy education certificate is a legal requirement to complete a bankruptcy in the United States. This completion of this course provides you with information regarding responsible financial and credit management. You can take a course meeting the bankruptcy requirements from a number of online providers approved by the US Trustee that will fulfill bankruptcy requirements.

Once you have completed your course, you will need to submit a copy of your completion certificate to your bankruptcy attorney and to the court. Most schools do not submit certificates to the court on your behalf.

Also, if you are filing for bankruptcy jointly with a spouse, you with both need to complete the required courses and submit the completion certificate to the court and give a copy of it to your attorney.

There are ...
... also specific time limits on when you have to take the courses required for bankruptcy. If you file for Chapter 7 bankruptcy, you must take the post-filing course after you file for bankruptcy and within 45 days after the first meeting date with your bankruptcy trustee and creditors. If you file for Chapter 13 bankruptcy, you are required to take the post-bankruptcy course once you have filed for bankruptcy and no later than the date of the required last payment as specified in your bankruptcy plan.

Pre-Filing Course vs Post-Filing Course

There are two different kinds of bankruptcy education certificate courses available. A pre-filing course allows you to meet the legal requirements for credit and debt education if you have not yet filed for bankruptcy. If you have already filed for bankruptcy, then you will need to take a post-filing course before your bankruptcy can be completed and discharged. You are required to complete both a pre- and post- bankruptcy filing course in order to meet the debt education requirements, according to the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA).

Other common names for these courses include debtor education, pre-bankruptcy classes, bankruptcy exit courses, and personal financial management courses. Generally, all of these terms refer to the same types of courses. However, before signing up for any bankruptcy course, make sure you have a good understanding of that the course entails and whether or not it is approved by the court for bankruptcy requirements.
