No Win No Fee Claims: Winning Big Or Losing Huge

Googling the phrase ‘No win No Fee' returns countless articles and advertisements about solicitor firms and insurance available. There are different aspects of a Conditional Fee Agreement that is explained in those tiny sentences on any ‘No Win, No Fee' ad.

The general prevailing notion is that ‘No Win No Fee' condition goes along with ‘100% compensation guarantee' as shown in the ads. Well, that not only looks pretty appealing if you are inclined to have a greater probability of losing the case, but also if you are on the other side of the river, you will not have to pay your solicitor and the court fee, as that will be taken care of by the losing party.

Not all cases are accepted by solicitor firms on the ‘No Win No Fee' terms. It's pretty obvious that a solicitor will sign a Conditional Fee Agreement only if he believes that there is a greater chance of winning the case. Usually, cases involving criminal/intentional injury and medical negligence in following conditions are not preferred by solicitors who offer sign a ‘No Win No Fee' agreement with you. Incase if you believe you are at the risk of losing the case and reluctant to pay the fee of the other party's solicitor and the court fees on the event of losing, so can approach an insurance company offering you an After the Event insurance, commonly referred as ATI or ATI where the insurance company is liable to cover the expenses of the defending party in the calamity of losing the case. Some insurance firms even undermine itself where you will not have to pay anything (not even the premium) in the event of losing the case. You will be liable to pay the premium only after the closure of the case and success of the case is declared in your favor.

If you are on a predicament of being the defendant, you can always buy the different kind of insurance called the Before the Event Insurance (BTE) which will cover all the expenses involving the solicitor's fee, court fee and other legal expenses. The terms and conditions of the BTE differ between cases but still in essence, it keeps you out of worries.

Most of the time people are reluctant to use this clause as they think there are other hidden expenses surrounding the legalities but No Win No Fee is a fairly simple agreement.
