Frequently you hear, We have investigated your case and found that you owe or You cannot declare bankruptcy on our type of debt. All these are empty threats which debt collectors use to make you feel insecure and guilty. No matter what your situation is in the debt situation, you are protected by federal law. The Fair Debt Collection Practices Act (FDCPA) constituted to protect illegal collection methods and debt collection harassment is enforced by the Federal Trade Commission (FTC) and private attorneys to ascertain a fair collection process.

Debts that have crossed the Statute of Limitations (SOL) time period also are attempted for collecting by debt collectors. Instead of getting intimidated by these collectors it would be wiser to be proactive. Get as much information about debt collectors as possible. While collecting such information do not commit on any payment. Ask for details of your debt and encourage the debt collectors to talk. It is possible that during such conversations they might slip up and you may use such information to nab them.

If you have found their lies, get as much close to them as possible ...
... and crack answers for your impossible questions. Get their mailing address and send a cease and desist letter with a return receipt request. Clearly state how they can communicate to you in future should there be any need. Once you receive the return receipt showing that they received your letter, state in no uncertain terms that they were violating the FDCPA by calling you. Inform them that you were hiring an FDCPA attorney and that for any further information they should call only your attorney.

Keeping a record of all phone calls, letters, emails and faxes etc is a very good idea to follow while in communication with debt collectors. Information is power and keep yourself informed about your rights under the FDCPA and be ready to sue the debt collectors. Even if you owe, you are protected by the FDCPA for a fair debt collection. No matter who all these debt collectors fool, you should not allow them to get an upper hand with you.

You can be free of your anxiety after engaging an FDCPA attorney who can take care of your legal work. CollectionStopper.com is the Number one law firm fighting for consumers in the FDCPA area of law. Attorney Brian Parker has tried more cases for consumers than any attorney currently practicing in the FDCPA area.
