Can An Ndis Provider Refuse To Take You On? Here’s What You Can Do
Signing up with the right service provider for your support needs as an NDIS participant is almost as important as getting the NDIS funding itself. But sometimes, your preferred disability support services may not want to onboard you. Contained in the coming sections are actionable steps to take when NDIS providers refuse service.
Why Might an NDIS Provider Refuse Service?
This can happen for several reasons.
Your preferred provider might not have the experienced support worker you need for the kind of support you require. It could also be a location thing.
For example, if the participant has an intellectual disability, their support workers have to be versed in certain communication methods and possibly, behaviour support. This could lead to you getting the “NDIS Provider Refuse Support” response from your chosen provider.
They will have to be honest about their capabilities, however, for this to work. If a provider accepts a job, knowing they do not have the capacity to deliver on it, that amounts to fraud.
What to Ask When an NDIS Provider Refuses Service
Do not assume there ...
... is foul play afoot if your request for support is refused. They may be incapable of providing certain kinds of support, especially if they are specialist supports like Supported Independent Living (SIL) or mental health support. To rule out foul play, ask:
- If they cannot provide support because of your location.
- If they cannot provide support because they don't have the right type of support staff.
- If they are at capacity.
- If your funding or service requirements do not meet their benchmark.
- If there is a mismatch between your needs and what they actually do.
A clear answer can help you avoid repeating the same problem with another provider. However, if there is foul play, like a provider refusing service for discriminatory reasons, you have the right to reject their refusal.
The Disability Discrimination Act 1992 protects the rights of people with special needs. You can also contact the NDIS Quality and Safeguards Commission for help with discriminatory providers.
Documents to Prepare to Not Make an NDIS Provider Refuse Service
Avoid the “NDIS Provider Refuse Support” response by making sure you approach your preferred provider with the following:
- Your main support needs: Helps the provider assess whether it offers the right service
- Preferred days and times: Allows the provider to check availability
- Location: Confirms whether workers can travel to you
- Communication preferences: Helps identify suitable workers
- Sensory sensitivities: Allows the provider to consider environmental needs
- Behaviour support requirements: Helps establish whether appropriate staff are available
- Visual expectations: Makes routines, communication and activities clearer
- Relevant goals in your support plan: Helps connect services with your NDIS-funded supports
If you have a Support Coordinator, they can help you curate these and communicate them clearly with providers. Support coordinators can also help you identify the lapses if you have had rejections, so that your next application will be successful.
They can also help you understand your service agreement with a provider who communicates their decision to stop supporting you. This is important, as your service agreement outlines how terminations, if need be, can be done. Every participant must have one from an NDIS provider, as mandated by the NDIS Quality and Safeguards Commission.
Finding Another Provider After an NDIS Provider Refuse Service
If, after a carefully curated document listing all the things above and some of your personal information, you still get a rejection, worry not. There are many providers who can offer you the service you require.
To avoid another rejection, however, please ask the following questions:
- Do you provide the support I need?
- Do you have workers with relevant experience?
- Do you currently have availability in my area?
- Can you accommodate my communication or sensory requirements?
- What will the service agreement cover?
- How can concerns or changes to support be handled?
The goal is simply not to avoid the “NDIS Provider Refuse Service” response, but to find one that can deliver appropriate, safe and reliable support.
