Amendments:
Software outsourcing is an ever changing field and laws related to it also change rapidly. Often the changes are as frequent as once in a year. Hence it is important that you check if the laws you were aware of are still in place. If in case they are not there then check for the changed laws.

International contract laws:
Two different companies indirectly come into contract when a software outsourcing contract is entered into and this makes it all the more complicated because outsourcing laws in different countries are different. Outsourcing laws of a single company are insufficient to cover both the companies from different countries. Thus we have private international law, here it becomes important to decide which law will be applicable if in case anything goes wrong.

Freedom to Select:
This is the single most legal aspect which has lead to the rapid development of outsourcing to India industry. India gives liberty to companies to select which laws will apply in which situation. They can also decide which court will perform the jurisdiction. Indian Civil Procedure Code's section number 13, 15 and 44A as well as section 41 of the Indian Evidence Act govern the enforcement and conclusion of foreign judgment made in India.

Statutory law compliance:
In some cases it has been found that if the provider of software outsourcing service is not compliant with statutory laws then the stakeholder is held responsible for any violations. To ensure you do not fall into any such situation it is important that you do a background check of the company you are going to work with.

Dispute Settlement:
Laws of different countries are different for software outsourcing. For dispute settlement the contract for software outsourcing should clearly mention where the case will be filed in case of fault. The laws of the place where the dispute will be filed for settlement will of course be different. Hence it is crucial to include clause regarding dispute settlement in your agreement.
