Salaried But Still Owed Overtime? The $684 Rule In 2026

Being paid a salary does not automatically mean you lose overtime. That is one of the easiest payroll rules to misunderstand.
In 2026, most employees treated as exempt under the federal executive, administrative, or professional exemptions generally must pass both a salary test and a job-duties test. The current federal salary level is $684 per week, equal to $35,568 for a full year. The Department of Labor restored that level in May 2026 after removing regulatory language from a 2024 rule that had been vacated by a federal court.
So if a pay stub says “salary” or an employer calls someone exempt, that label is only the beginning of the answer.
Start With the Weekly Salary
First, check how much salary is guaranteed each week.
For most executive, administrative, and professional exemptions, an employee generally must receive at least $684 per week on a salary basis.
Suppose Maya earns $32,000 a year. Dividing that amount across 52 weeks gives about $615.38 per week. That is below the federal $684 level.

A pay stub may show salary by pay period instead of by week. Someone paid every two weeks might see one larger amount rather than a weekly figure. A $684 Salary Does Not Automatically Make You Exempt
This is the part employees often miss.
Meeting the salary level does not finish the test. Actual job duties matter too.
An employee may qualify under the executive exemption when the required management duties are met. Certain administrative employees may qualify when their work involves the type of discretion and responsibilities covered by the exemption. Some learned professionals may qualify because their primary work requires advanced knowledge.
The Department of Labor makes clear that both compensation and job duties matter. A job title alone does not determine exempt status.
That means putting “manager” on a business card or payroll profile does not magically remove overtime rights.
Consider someone called an assistant manager who spends nearly the entire shift stocking products, operating a register, cleaning, and handling the same work as hourly staff. The employer may need to look at what that employee actually does, not simply the title entered in payroll.
What Does Exempt Mean for Overtime?
When an employee is legally exempt under an applicable FLSA exemption, the usual federal overtime requirement may not apply.
A covered nonexempt employee, on the other hand, generally must receive at least one and one-half times the regular rate for hours worked beyond 40 in a workweek.
Being salaried and being exempt are therefore two different ideas.
Payroll systems may show one salary earnings line without displaying regular and overtime hours. That does not prove the worker is correctly classified. If there is uncertainty, keeping independent records of weekly hours can be useful.

A Simple Example
Imagine Jordan receives a fixed salary of $650 per week and works 46 hours.
Jordan is paid on a salary basis, but $650 is below the current $684 federal salary level for the standard executive, administrative, and professional exemptions.
If Jordan is a covered nonexempt employee, an employer cannot solve the issue simply by saying, “The extra hours are included because you receive a salary.”
The proper overtime calculation can depend on the salary agreement and other facts, so employees should not simply divide salary by 40 and assume that produces the legally correct answer.
The more important first question is whether the exemption applies at all.
Can an Exempt Employee’s Salary Change Because of Hours?
The salary-basis requirement also affects how qualified exempt employees are paid.
An exempt employee generally receives the predetermined salary for a week in which work is performed, subject to permitted deductions. The employer normally cannot reduce that salary simply because the business was slow or there was less work available. Federal rules do permit deductions in certain specific situations.
If a normal salary suddenly falls on one paycheck, review the earnings section before looking only at the direct deposit.

State Rules Can Change the Answer
The $684 figure is the federal standard. Employees may also be protected by state wage-and-hour rules.
That matters especially for employees working remotely or for companies with workers in several states. Payroll should check the rules that apply where the employee works instead of assuming one federal calculation answers every case.
The federal threshold should therefore be treated as a starting point, not permission to ignore applicable state requirements.
If Your Paycheck Looks Wrong
Do not begin with the job title. Begin with the records.
Save several recent pay stubs. Note the salary amount, pay period, actual weekly hours, overtime lines, and any changes from earlier checks. Write down the duties you actually perform during a normal week.

Instead of only asking, “Why did I not receive overtime?” ask a more useful question:

A salary is a method of paying someone. Exempt status is a legal classification. They are not the same thing.

Check the weekly salary, actual job duties, hours worked, and applicable state rules together. A salary label on a pay stub tells you how the employee was paid. It does not, by itself, answer whether overtime is owed.
