What Is Medical Records Review? A Guide For Attorneys And Law Firms

A claimant stopped visiting her doctor for six weeks, and the insurance adjusters just thought she recovered. So now the claim is worthless. There’s no point in giving her the reimbursement.

But what happened exactly? The doctor referred her to meet a spine specialist. The earliest appointment was six weeks out. And the referral note saying so? Yes, but it’s buried in Page 219 in a 600-page file.

It helps the insurance, legal, medical, and other firms in understanding the case.

● Summary. A medical record summary is a structured document that clearly explains the patient's history before and after the injury. This turns thousands of pages of medical records into a valuable document so that healthcare professionals, insurers, attorneys, case managers, and paralegals can act on immediately. It’s not just the notes. It saves hours of time in reading medical records line by line.

● Judgment. This part has a hard name but is impossible to replace. Here, a trained reviewer reviews the medical records for factual errors. It may be a diagnosis that doesn’t match the injury mechanism, or a billing entry for a procedure that never appeared in the clinical notes. A person sorting pages by date can miss all of these. Causation

Almost all contested claims come down to one question. Did the particular injury actually cause this impact on the claimant? Or was it something else going on before the incident even happened?

A strong medical opinion can be weakened if the underlying records are missing key facts, treatment history, or relevant pre-existing conditions
under cross-examination.

The side with the complete, accurate, and defensible interpretation of the medical records usually wins the battle.

Settlement Value

Disorganized records create ambiguity. And insurers love ambiguity because it gives them every reason to lowball the offer.

A clean medical record takes that away. Treatment gaps get explained. Recovery milestones are documented. Physician opinions are right there.

Every small note matters, and it has a great impact on settlement value.

Missed Statements

A pre-existing condition that you missed during the review doesn’t stay hidden. It surfaces eventually, at any time. The only question is when.

Find it yourself during the review, or it shows up through the narrative summary. Imagine confronting opposing counsel during your client’s deposition and you have lost your credibility and your negotiating leverage at the same moment.

A good review means you meet the bad facts on your schedule, not theirs.

Why It Is Hard

Two things: volume and the kind of attention the work demands.

A serious case can run anywhere from thousands of pages to 10,000. Reading all of it takes a well-trained, certified person a lot of time, and it’s labor-intensive. This time cannot be afforded by professionals who value time.

So the review gets rushed and handed to whoever is available, and the gap doesn’t show up until there is an error or a missing document which changes the entire theory of the case.

The second problem is that the kind of attention medical records review needs is quite specific. Reading a medical record is nothing like reading a contract. The context changes everything. The same abbreviation can mean one thing in cardiology and a completely different thing in radiology.

A casual line about a referral that goes nowhere is, to a trained eye, a flag that a record is missing entirely. You cannot flag what you cannot read. You need to give proper attention to medical records review to focus better on the case.
