When Can UAE Police Stop, Search, or Arrest an Individual?
Police powers to stop, search, arrest, and detain sit at the intersection of two objectives that the law must hold in balance: effective law enforcement and protection of personal liberty. In the UAE, that balance is framed primarily by Federal Decree-Law No. (38) of 2022 on Criminal Procedures, in force from 1 March 2023.

Police encounters generally escalate in stages. The legal basis required for each stage is different. A key dividing line in UAE criminal procedure is whether the circumstances indicate that an offence is occurring now or has just occurred, such that immediate intervention is justified to prevent escape, preserve evidence, or protect the public.

A. When UAE Police Can Stop an Individual
A stop is primarily a fact-finding and scene-control measure. It allows officers to clarify what is happening, manage immediate risk, and verify identity where necessary. ... as a routine enquiry, but it should escalate to a search or arrest only where the legal conditions for those steps are satisfied.

Common situations where a police stop may be justified
Police may stop and engage an individual where the circumstances present an immediate and reasonable basis related to public safety, prevention, or investigation, such as:

•Public safety checks to prevent harm, respond to a safety risk, or manage a public disturbance.

•Active incident response where an incident has just occurred and officers are identifying involved persons, witnesses, or persons leaving the area.

•Reasonable concern based on the situation where the surrounding facts suggest a recent offence, an imminent offence, or a risk to the public, including where behaviour appears suspicious in context (for example, a vehicle parked for an extended period late at night in a quiet street, or a person loitering or repeatedly walking in a residential area at unusual hours).

•Lawful operational controls such as traffic enforcement, checkpoints, or other controlled operations aimed at compliance and safety.

At this stage, the purpose is generally to stabilise the situation, verify identity where necessary, and gather basic information, so officers can decide whether the matter ends as a routine enquiry or escalates into formal procedures (such as reporting, search, or arrest) where the legal threshold is met.

What to do if stopped by the UAE police

•Stay calm and respectful; let the officer control the initial interaction.

•Answer basic questions briefly and consistently.

•Provide identification where requested.

•Do not question/escalate the situation with the police; if there is a dispute about the legality of the stop, it can be raised through proper channels later.

•If the situation escalates to arrest, it is generally prudent to avoid giving detailed statements before legal advice and to focus on requesting counsel and understanding the allegation.

B) When UAE Police Can Search an Individual

1) Personal Search

As a general rule, a personal search is tied to situations in which arrest is legally permitted. That is why a stop may remain limited to fact-finding, while a search requires stronger grounds.
A personal search will typically cover the person’s body, clothing, and items being carried, such as pockets, bags, or similar belongings, for the purpose of locating items linked to the suspected offence.

2) Search of Home

The starting point is that the police cannot enter and search a home on their own initiative. Search and entry is allowed only in the limited cases prescribed by law, and a search of the accused’s home requires a written warrant from the Public Prosecution. That position is subject to a narrow exception where the offence is taking place or has just taken place, and there is strong indication that items or evidence relevant to the case are being concealed inside the home.

C. When UAE Police Can Arrest an Individual

Arrest is the highest level of in-person intervention because it deprives a person of liberty. The law therefore limits immediate arrest powers to defined situations, most commonly where the incident is fresh (“caught in the act”) and the offence is of a type that allows arrest.

Where an alleged misdemeanour is punishable by a fine only, it does not fall within the law’s immediate arrest ground for “caught in the act” misdemeanours that is expressly tied to offences where the penalty is not a fine. Arrest would therefore require a separate lawful basis under the statute. This does not rule out arrest on other statutory grounds where applicable; the arrest analysis remains fact-specific and depends on the offence type, penalty, and available evidence.

Scenario 1: A person is stopped after committing a minor municipal violation that carries a fine only, such as littering in a public place. The officer requests identification, notes the relevant details, and issues the applicable penalty. Since the violation is punishable only by a fine, it would generally be handled through documentation and fine issuance, rather than arrest under the UAE rule that excludes fine-only misdemeanours from that arrest ground.

Scenario 2: A person punches another person during an argument in a public place, causing visible injury. Since the incident occurs in public, attracts attention, and is witnessed by others, it may be treated as a matter affecting public order and safety. If the suspected offence is punishable by imprisonment, the police may arrest the individual and the case will usually proceed through the normal criminal process, including referral to the Public Prosecution.

If the same incident takes place in private and the individuals later attend hospital, the police may still become involved following the hospital’s notification and may prepare a police report. In that situation, whether the matter progresses often depends on the type of offence and the available evidence. If the law requires a formal complaint from the injured person or another authorised person, the absence of that complaint may prevent the case from moving forward. But if no such complaint is required, or if there is independent evidence such as CCTV, witnesses, admissions, or serious injury, the authorities may still proceed.

D) What Happens after UAE Police Arrest an Individual

1) Once an individual is arrested, police will take them into custody and complete the initial procedures (identification, recording the incident, and preparing the arrest file).

2) If the accused does not furnish evidence of innocence, they must be referred to the competent Public Prosecution within 48 hours.

3) The Public Prosecution must question the accused within 24 hours, and then decide whether to remand the accused in custody or order release.
