Visa interviews can be a source of anxiety because they play a large role in determining whether your visa is granted or denied. Working with a NY visa lawyer can alleviate this stress because they can guide you on how to effectively address interview questions and navigate the process. They also maintain current knowledge of evolving interview regulations, which is crucial, especially given recent changes.

For example, on February 18, 2025, the US Department of State announced revisions to the Visa Interview Waiver program that directly impact who is required to attend an interview.

What exactly has changed?

Under the updated regulations, you may qualify to skip the in-person visa interview (receive a waiver) if:
• You hold certain diplomatic or official visas (A, C, G, NATO, or TECRO).
• You are applying for a diplomatic or official visa.
• You are renewing a visa within the same category, and it expired less than 12 months ago.

What are the requirements?

You’re required to meet specific requirements when seeking an interview waiver. Your NY visa lawyer can offer ...
... clarifications to ensure that you’re qualified. Specifically, you must demonstrate:
• No potential or apparent ineligibility for a visa
• No prior visa refusals, unless the refusal was subsequently waived or overcome
• Application for the visa in your country of residence or habitual residence

The 12-month window

Previously, non-immigrant visa renewals in the same category were eligible for interview waivers if the prior visa had expired within 48 months. That window has now been reduced to 12 months. Therefore, if your prior visa expired more than 12 months before your renewal application, you need to go to an in-person interview at a US Embassy or Consulate.

What does this mean for you?

Recent visa restrictions and staffing changes at US Consulates may lead to longer wait times for visa appointments, particularly in countries with existing backlogs.

If you are applying for a work visa and do not qualify for an interview waiver, prepare for potentially long wait times for your interview. You and your employer should immediately verify your waiver eligibility and begin the application process as soon as possible.
