Are you planning to bring your family to the US? Then, it's crucial to stay updated on the latest USCIS guidelines — including the introduction of Form I-13IF, which the USCIS started accepting on August 19, 2024.

Form I-13IF is the new electronic form for Application for Parole in Place for Certain Noncitizen Spouses and Stepchildren of US Citizens. A family immigration lawyer in New York can provide more information.

Online only

Form I-131F can only be submitted online — there is no paper version. Each individual requesting parole in place (including minors) must file their own separate application. All applicants will also need to create a USCIS online account.

To assist families in the online filing process, the USCIS has released a filing guide and updated their key questions and answers on the Keeping Families Together page.

Who can file Form I-131F?

A US citizen's noncitizen spouse or stepchild may request parole in place if they meet the following criteria:

• They are currently in the US without parole or admission.
• They have resided continuously in the ...
... US since June 17, 2024.
• The spouse is legally married to a US citizen as of June 17, 2024.
• The noncitizen parent had a legally valid marriage to a US citizen on or before June 17, 2024, and before the stepchild's 18th birthday.
• They have no disqualifying criminal history and do not pose a threat to public safety or national security.

Note that meeting these criteria does not automatically result in approval. The USCIS may deny a request if they determine that parole is not warranted in a specific case.

It's also important to note that even individuals who have an outstanding removal order or are currently in removal proceedings may still qualify for parole.

If you have questions about your eligibility or need legal assistance, talk to a family immigration lawyer in New York.

Protect yourself from immigration scams.

Unfortunately, scammers often prey on people who are doing their best to join their families in the US. To protect yourself and your loved ones, seek legal advice only from a licensed attorney authorized to practice law in the United States.
