Does your pain affect your ability to raise your children or perform your normal, everyday tasks? How much time do you feel you’ll realistically need for recuperation? Does your physician feel that full recuperation is possible? Will you need pain medication, and how much will that cost? How long will you need the medication? How long will you be out of work? Will you be able to resume your normal work activities when and if you return? If you’re a homemaker, what is the value of the services you provide, and how long will your at-home job be affected? What is your age? (If you’re younger, you’ll be able to heal quicker than if you’re an older person.) Have you had a pre-existing injury or chronic illness that precluded you from enjoying a standard quality of life before the accident?
All of these are questions that need to be addressed before attorneys can determine the actual amount of a pain and suffering insurance settlement.
Often an attorney will employ a “personal injury calculator†to determine how much the insurance settlement should be. This calculator determines the potential worth of your personal injury claim by factoring in several components, including: the amount of suffering, the entire financial loss, and the percentage of negligence by all parties (if you were partly responsible for the accident, for example).
