If you’ve been injured in an accident and it caused you pain and suffering as the result of another person’s negligence, then your best recourse will be to contact an attorney. An attorney is the only way to potentially file a lawsuit, but more importantly, an attorney can help you get a insurance settlement without ever going to trial.

The vast majority of personal injury claims result in a settlement instead of trial. If the facts are clear-cut, then it costs everybody less money and time to make a settlement for pain and suffering. One of the biggest hurdles your attorney will overcome is determining the actual amount to ask the negligent party’s insurance carrier for. Once fault has been determined, the attorneys have to hash out expenses that have been incurred by you, including medical, prescriptions, physical therapy, actual loss of property, time lost from work (past, present and future), home health care, equipment needed for rehabilitation, and pain and suffering. The last part is often the most difficult to determine, because it is not based on actual bills ...
... received or actual goods consumed in the quest to make you feel better

There are a large number of factors to take into consideration before determining the amount someone should be compensated for pain and suffering. Everyone is different, and what may lay you out for years would not affect someone else in the same manner (and vice versa). There should always be a thorough examination by a physician. Questions will need to be answered such as how much were you able to do in your general life before the accident? How is that changed now? What do you do for a living? How is your employment affected? Is your pain and suffering affecting your home and work relationships? Does your pain affect your ability to raise your children or perform your normal, everyday tasks? How much time do you feel you’ll realistically need for recuperation? Does your physician feel that full recuperation is possible? Will you need pain medication, and how much will that cost? How long will you need the medication? How long will you be out of work? Will you be able to resume your normal work activities when and if you return? If you’re a homemaker, what is the value of the services you provide, and how long will your at-home job be affected? What is your age? (If you’re younger, you’ll be able to heal quicker than if you’re an older person.) Have you had a pre-existing injury or chronic illness that precluded you from enjoying a standard quality of life before the accident?

All of these are questions that need to be addressed before attorneys can determine the actual amount of a pain and suffering insurance settlement.

Often an attorney will employ a “personal injury calculator” to determine how much the insurance settlement should be. This calculator determines the potential worth of your personal injury claim by factoring in several components, including: the amount of suffering, the entire financial loss, and the percentage of negligence by all parties (if you were partly responsible for the accident, for example).
