All You Need To Know About Divorce For Non-muslims In Uae
The UAE's recent enactment of the Federal Personal Status Law (Federal Law No. 41 of 2022), which came into force on February 1, 2023. This law encompasses vital family matters such as marriage, child custody, divorce, and inheritance. Legal experts suggest that the new personal status law for non-Muslims in the UAE has been designed with the objectives of advancing gender equality, addressing concerns related to joint custody, and streamlining the divorce process for non-Muslim expats living in the UAE.
The proactive measures by the government have created a more convenient framework for non-Muslim residents and expatriates from across the globe to align their personal lives with their individual values and preferences. This has been done without causing conflicts with the cultural and religious beliefs that apply to both native and foreign Muslims in the UAE.

In some cases, the court might suggest mediation as an option for reconciliation before proceeding with the whole divorce process. If reconciliation efforts are unsuccessful, the court will issue the divorce if the grounds for divorce are substantiated. Either party has the option to challenge the court's decision within 30 days from the date of the judgment.
Typically, when filing for divorce in the UAE, certain documents are necessary, including the marriage certificate, passports and residence visas of both spouses, financial records, and a custody agreement if there are children involved.
In situations where the legal system in the parties' home country does not address a specific aspect of the divorce procedure, the UAE courts have the authority to apply UAE law.
