According to Section 276B of the Income Tax Act, they could be prosecuted if the tenant doesn't pay the TDS on time. It might result in imprisonment for three months to seven years.
According to Section 271C of the Income Tax Act, a tenant who pays rent to an NRI landlord without deducting tax may also be subject to a fine equal to the TDS amount.
