The parents must be legally wedded for the father to avail of the paternity leave. They must also have less than two children to be eligible for the paid leave. Additionally, they must avail of it within six months before or after the date of delivery of their child. If they have more than two children or fail to apply within the stipulated time frame, the paid leave provision becomes invalid.
There is no mandatory legal provision for paternity leave in the unorganized and private sectors in India. While many multinational companies have instituted the policy, most private companies and businesses may or may not do so at their discretion. If you work in the private sector, it will be a good idea to contact your company's HR department in advance of the impending birth and find out if it has a paternity leave policy.

To write a paternity leave application, you may find it useful to follow these steps:
If you are writing an email, include "application for paternity leave" or "paternity leave application" and your name in the subject line. That way, your manager will know the email's context at a glance.
1. Try to keep the email body content concise and relevant.
2. Briefly explain why it is essential for you to be with your family.
3. Provide the dates for the period in which you want to take paternity leave.
4. Take a responsible stance regarding your company and mention how you have arranged for work projects to continue uninterrupted in your absence.
5. If you have asked colleagues to handle your work for you, state that clearly.
6. Provide your contact details in case the manager needs to get in touch with you regarding any work issues.
7. Give the exact date when you will be back in the office to resume your job responsibilities.
8. End the paternity leave application by thanking the manager for their understanding and their time.
