It is mandatory that both of them are 18 years or above in age. The person one wants to join must be a British Citizen. The marriage or civil partnership has to be recognized by the UK. Also, the relationship between the two persons must be at least 2 years old, at the time of the application. In the case of finance, it has to be proved that the marriage will take place within a period of 6 months. Similarly, in case of proposed civil partners, it has to be proved that they will enter into a civil partnership within a period of 6 months. The partner who is the UK resident also needs to be meeting the financial benchmark. The applicant has to meet the requirements of English understanding. While visiting the consular officer, certain documents have to be submitted mandatorily-form VAF4A, passport, two-passport sized colour photographs, English language requirement proof, proof of financial criteria, proof of relationship (marriage certificate, photographs, etc.), previous immigration applications, biometric information, proof of accommodation in the UK, certificate regarding criminal record, spouse visa paid fees receipt, etc.

In case the applicant wishes to bring along dependents/children who are not EEA (European Economic Area) nationals or British nationals, for the first child the income has to be £3,800 more than what is specified and £2,400 more for each child after the first one. While making the application for the UK Spouse Visa, one of the most important document requirements is the English language requirement. This can be proved either by submitting a document showing academic qualification that involved teaching or research in English, and such is recognised as being equivalent to the UK bachelor's degree, at least, by the UK NARIC. Another way is to take and pass the English language test at an approved centre and passing the speaking and listening at level A1.

The UK Spouse Visa Application fees differs from one mode of making the application to another. If the application is made by the applicant from outside of the UK the application fee is approximately £1,464, whereas if the application is made by the applicant from within the UK, online or by post the fee stands at around £993. One can also make the application in person by means of a premium service, such an application fee is around £1,583.

For the children that the applicant wishes to bring along additional visa fees has to be paid. It takes up to 8 weeks to 12 weeks to receive an answer regarding the UK Spouse Visa if one has applied from within the UK by post or online. In case of in-person application an answer can be received even within a day from making the UK Spouse Visa application.

The validity of the UK Spouse Visa is also different for each applicant depending on the relationship status. For spouses, the permission to stay in the UK is for 2 years and 6 months. In case the applicant is a fiancé or a proposed civil partner, they are permitted to stay for 6 months. After the lapse of this period, their stay will have to be further extended. Only 28 days prior to the lapse of the given period applicants can apply for extension, however it has to be proved that the couple has been living together throughout the duration of the specified period, to successfully get such extension.
