A “Lemon” refers to a car with a significant defect caused during the manufacturing process, causing it to have major safety or utility issues. A lemon car can be quite difficult to spot before buying it, so it is unfortunately common for people to end up with faulty cars. This is when Lemon laws come into play. These laws are there to protect auto owners. Lemon laws force manufacture buy back or replace a faulty car. To qualify for a replacement or buyback, one needs to prove that their car is a lemon. The legal definition of a lemon car needs to meet certain requirements. They are as follows:
1. Several attempts to repair the car have been made: Your faulty car needs to be taken in for repairs a minimum number of times, and if each time the problem persists, then the car may be a lemon. The number of times you need to take the car for repairs varies from state to state, but generally, it is 3 to 4 times.
2. The car has substantial defects: You need to prove that your car has substantial defects that pose ...
... a safety or utility problem. The definition of a substantial defect can vary widely. Most of the time, a substantial defect would mean a problem with the brakes or the steering. However, it can also be a problem with the air conditioning, paint, or windows.
3. The car is out of service for 30 days or more: You need to prove that your car had been out of service for more than 30 days within a certain time period, usually one year. These 30 days need not be consecutive. If you received a loaner vehicle within these days, they would not be counted.
4. You have reported the damage to the manufacturer by letter: Finally, to qualify your car as a lemon, you must inform the manufacturers of your car’s defect. You cannot file for a lemon car suit if you do not let them know about the defect. Usually, you must report the defects via a letter to the manufacturer.
As soon as you suspect that your car is a lemon, contact a lemon law attorney and start collecting all the required paperwork.
