Role Of Homeowner's Association In Dubai
If you are buying (or living in) a separate house, you don't really need to worry about Homeowner's Association, however if you are looking to purchase an apartment/condominium in a jointly owned development then you must be alert to the role and functions of a homeowner association. By definition, homeowner association is a separate entity formed to oversee and manage common areas in a jointly owned property. Even though, it looks as if it's a pretty harmless committee that keeps an eye on common areas and watch over simple maintenance work, lack of knowledge regarding rules and covenants while living in an apartment complex (or any other jointly owned property) can get you in serious trouble.
For example you've bought an apartment, as soon as you move to your new residence, you're approached by the HOA and informed that you must get rid of your beloved pet in order to be able to live peacefully, since homeowner's association for this particular property doesn't permit any kind of pets. Every so often, HOA can impose restrictions that may sound hilariously odd, as well as proving ridiculously bounding at the same time. ...
... Therefore, at times this seemingly innocent entity can turn out to be a nonsensical association that's set out to make things difficult for you, whilst you are at their mercy. Bottom-line, make sure you've read and inquired about the rules and regulations of the concerned association in case you are buying or renting in a jointly owned property.
Homeowner's Association in Dubai:
New Strata Law allows, in fact directs everybody who's in the possession of jointly owned property in Dubai to be tuned in to the laws of their respective homeowner's association. According to the rules, Home owner's association will legally come into being when the first unit is registered in the owner's association register with RERA; once it is formed all unit owners will automatically become the members, while developers can represent the unsold units. The executive committee of all homeowner associations in Dubai must be having a chairman, vice chairman, secretary and treasurer (all of them duly elected by the members by majority vote).
Even though by-laws specific to the owner's associations are not issued as yet, general guidelines are there which state that small internal changes are allowed if they do not have a bearing on the peace or privacy of other owners. However, if you are looking to make significant changes in external or internal structure, then they must be approved by the association in advance.
