There is no doubt that facing deportation can be a highly terrifying experience for anyone. Deportation can be a frightening situation not just for the individual but also for their family. Each year, various people face the proceedings of deportation (removal) before the immigration judges. It occurs when the government orders an individual to leave the country. The laws surrounding deportation (removal) are highly complicated because of which it is highly advised to hire an immigration lawyer or a deportation attorney.

Being placed in the proceedings of deportation means a process is going to be started by the government that could end in an order of removal. Typically Department of Homeland Security cannot deport any individual without giving any notice and the chance to go before an immigration authority or judge to present his/her case.

It occurs when a foreigner is formally removed by the federal government from the United States for criminal laws or due to the violations of immigration. A person can be removed or deported from the U.S. if:

• He/she is convicted of a certain crime that is related ...
... to firearms, illegal drugs, or espionage
• The person is convicted of running away from an immigration checkpoint.
• The person will fail to register as a sex offender
• The person will violate the terms of their for gaining any immigration or other type of benefit
• The person failed to advise the authorities of immigration, in writing, regarding a change of address within 10 days of the shift
• The person is convicted of child abuse, domestic violence, child neglect, stalking, or child abandonment.
• The person intentionally provide false information required during the registration to the immigration authorities
• The person is currently an addict or a drug abuser or became one after the admission to the U.S.
• The conditional permanent resident status of the person has been terminated
• Helped to smuggle a foreigner into the U.S.
• Got married and divorced within a certain time frame

There are numerous other reasons because of which the government may choose to deport an individual. Even a citizen with naturalization may be subject to deportation when the individual is found to present false information while securing their green card. The process of deportation can result in an arrest for not improper documentation. During a deportation procedure, the key objective of a person will be to show that he/she has legal grounds for remaining in the United States.

If a person has been given the notice to appear, he/she have to present for a hearing in immigration court. There each case is properly heard by an immigration judge. The judge considers all evidence before giving a decision on either to allow the individual to stay in the US or to issue an order of removal.

Cancellation of the deportation:-
While seeking cancellation of deportation, it is vital to influence the Immigration Judge that although you have a criminal conviction, you still have very good parts to your life. You can prove this with your family ties in the U. S., payment of income taxes, rehabilitation, your job history, your child support payments, and the length of time that you have lived in the U.S.

You can convince them that how much it will tough for you as well as for your family if you will be removed. They should also convince the Immigration Judge that you have changed your life and you will never commit any crimes in the future.

If you are too facing removal proceedings, it is best to talk to an immigration lawyer as soon as possible. Being placed in deportation proceedings or being deported can have severe consequences for your chances to stay in the United States. For this, a lawyer can guide you on the best to save yourself from deportation.
