Hit and Run Lawsuits and Settlements: Many motorcycle accidents occur when a larger vehicle hits the motorcycle and injures or kills the operator. But in some cases, a motorcyclist may hit a biker or another motorcyclist. What should you do if you are hit by another motorcyclist and he flees the scene?
Whether you or your loved ones can get compensation for your injuries and damages depends on whether law enforcement can find the other driver. If they locate the other driver, you may be able to sue for your injuries and property damages.
If they cannot locate the driver, you may have to have ...
... your damages paid by your own insurance policy. Most drivers are required to have uninsured and underinsured motorist coverage on their policies. Check your policy to see how much coverage you have.
One of the problems with an uninsured motorist claim is your insurance company may try to underpay or deny your claim. You might think that your insurance company would be understanding if you are injured by a hit and run driver. But all insurance companies are in business because they pay out as little as possible in claims.
Whether you can find the other driver or not, you are generally entitled to collect compensatory damages for your injuries. These include both economic and noneconomic damages.
Economic damages are those that can be added up easily, such as your medical bills, lost earnings, and lost work time. You can gather the paperwork for these losses and give them to your personal injury attorney Portland Oregon. He or she will add up your damages and make that number part of your demand for settlement from the insurance company.
Noneconomic damages usually refer to pain and suffering that your injuries cause you. Proving pain and suffering is more complicated but still possible. One thing you can do is show your medical reports and bills to the insurance company to illustrate your pain and suffering. It helps if your doctor provides a statement about the pain and suffering you are enduring from your injuries.
Also, a statement from the doctor about your future pain and suffering can result in a higher settlement amount.
Being involved in a hit and run with injuries can be very confusing and hard to handle on your own. That is why it is a good idea to talk to the best Personal injury lawyer Portland online at Herron Law Firm about your case.
