Are Pure Hemp Oil And Cbd Oil Legal After The Farm Bill?

Ever since the passing of the Agriculture Improvement Act in 2018, the number of people lining up to buy pure hemp oil and CBD oil has increased more than ever. But restrictions at the state level and by the Food and Drug Administration (FDA) continue to cause a lot of confusion. This confusion is further fuelled by the confusion between hemp seed oil and CBD. The restrictions don’t seem to have any effects on the sales of hemp or CBD  products but could land people at the wrong end of the law. To clarify what’s legal and what’s not, here’s a look at some facts:
Is Pure Hemp Seed Oil Legal?

This is because the seeds themselves don’t contain any amount of THC or CBD. During harvesting, the seeds may come in contact with other parts of the plant and get trace amounts of these compounds that are harmless for consumption. So, hemp seed products can be sold across the US for food and drinks as long as it does not claim to have any medical properties.
Is Hemp Legal?
The 2018 Farm Bill removed hemp and its derivatives from the Controlled Substances Act thus legalizing them under federal law. This means that licensed farmers can grow hemp and transport it across the states as long as they follow the regulations set. The federal definition of hemp as Cannabis sativa plants with less than 0.3 percent THC. This could be a boon for food, medicine and car industry. However, unlicensed producers and sellers could face legal actions so don’t start digging your backyard yet.
Is CBD Legal?
Many people have translated the Farm Bill as allowing CBD to be extracted from the hemp plant to be sold and bought. The internet has been flooded with ads and blogs about the supposed benefits of these products. So it may come as a surprise to many that the FDA still holds the right to approve cannabidiol products.
At a federal level, CBD products are only legal if they contain no more than 0.3 percent of THC, are derived from hemp plants and are approved by the FDA under the PHS Act’s Section 351 and the FD&C Act. And the agency does not allow its use as a dietary supplement, for therapeutic use or in food products without approval. They have sent letters warning to many companies for violating these rules. So far, the FDA has only approved Epidiolex for treating seizures for two rare forms of epilepsy which are Lennox-Gastaut syndrome and Dravet syndrome.
However, cannabidiol can be used in cosmetic products because, under the FD&C Act, these products are not subject to pre-market approval. 
Moreover, many states approve the sales, purchase and use of CBD extracted from hemp. Some states even allow CBD oil extracted from Marijuana for food, recreation and medicine.
Is Marijuana Legal?
Many people confuse hemp for marijuana which is why some confuse the legalization of hemp with that of marijuana as well. Firstly, marijuana and hemp are not the same plants. They are both strains of Cannabis sativa but that’s where the similarities end. Marijuana contains 30 percent THC which intoxicates the brain. This is the plant used to make weed. Hemp only contains 0.3 percent THC and 20 percent CBD so does not cause such reactions.
At a federal level, Marijuna as yet to be legalized and is classified as a Schedule 1 drug. But is legal for recreational and medical use in some states with more pushing for acceptance. Now that you understand the laws and restrictions, the decision to buy pure hemp oil and CBD oil is yours.
