Criminal Defense And Arrest Getting Educated
Have you recently been charged with a crime and arrested? Have you been charged with a crime and are awaiting trial? There are some legal issues that are important and should be considered as your criminal defense and arrest goes through the system. You don’t have to sit with hands tied behind your back, you can take some action that can help in your trial and the criminal defense and arrest warrant against you.
You have the right to remain silent: this is the Miranda warning given to everyone who is charged with a crime and arrested. Law officers are often caught between a rock and a hard place and may sometimes record the wrong facts. If it is a DUI arrest or any other charge for that matter, you can cooperate completely with the police, if it means doing the breathalyzer test or anything that is asked of you without saying anything or agreeing to anything. You should talk to your attorney before you talk to the police. Once you agree to talk to the police, everything you say will be recorded and can be used against you; in such a situation there is not much a lawyer can do for you if you have ...
... already been shooting off your mouth!
Use your right to one phone call to contact a criminal defense and arrest attorney; do your best to get hold of someone who has considerable experience in this field and can successfully manage the charges being levied against you. Once you get your attorney on board, he will advice you and put things in motion to gather information and bring the case to trial. Once you have been advised by the police that you are a suspect in an on going investigation, you should contact your attorney without any delay.
Criminal defense and arrest go hand in hand: if you have been arrested, contact your lawyer as soon as you are allowed to make your phone call and work with him to post bail at the earliest, you don’t want to spend even one night in jail! If you delay on posting bail, it can become more difficult as time goes by to get a reduced bond. Remember that the prosecutor for the opposition has time to build a case against you and will be more strongly opposed to a lenient bail amount.
Analyze the entire incident and identify people who can be used as witnesses: give your lawyer all the information you can for him/her to follow up and interview people, take depositions and generally prepare the case on your behalf. Police do not always get around to interviewing all the witnesses in a case due to their own heavy caseloads and more urgent crimes taking precedence. The sooner your lawyer can track people down and get witness statements the better; with time memories fade and also finding people may become difficult.
When you are charged with a crime, get your criminal defense and arrest attorney on the job right away.
