A Quitclaim deed is the name given to a legally binding document that releases the interest or claim of an individual on a specific real estate property and then passes it on to some other person. These may be used in different situations, such as to get rid of doubts on title, as gifts or tokens, for the transfer of real estate property between members of families or during a divorce. In these situations, a spouse who foregoes interest on property is referred to as the ‘grantor’ whereas the spouse owning the property is called the ‘grantee’. The grantee shoulders the risks, particularly because the title has no warranty.

During the sale of a residential property

An owner, at the time of sale of a residential property, typically needs to file a quit claim deed with their state’s county. Then, the document transfers the interest of the home to the purchaser from the seller. It is also used when several siblings inheriting a family home and sharing its ownership sells the property to a new owner. Prior to the sale, however, a sibling may already sell his own share in the house to some other sibling. He can sign this type of transfer deed form to relinquish his interests and rights in the property.
