Hipaa Security Provisions Now Apply To Business Associates

In February 2009, the healthcare industry took notice as the House of Representatives and the Senate debated and passed the Federal Economic Stimulus Bill, the American Recovery and Investment Act of 2009 (ARRA). The bill, which was signed into law on February 17, allocated $30 billion for the improvement of the US healthcare system.


Embedded in the stimulus bill is the Health Information Technology for Economic and Clinical health Act (HITECH Act) which widens the scope of Health Insurance Portability and Accountability Act (HIPAA).


Lots of the law's new HIPAA requirements take effect from early next year. Many of the provisions will require physician practices to re-evaluate and update their privacy and security policies. As such, providers and other covered entities should start preparing for compliance now.


As per the stimulus bill, various HIPAA security provisions now apply to business associates in the same fashion as those that apply to covered entities. ...
