Als Partners Uit Elkaar, Ook Als Ouders? | Boskamp & Willems Advocaten By: Samantha Dale
Stel, u gaat uit elkaar en u heeft minderjarige kinderen, dan doet u er verstandig aan een ouderschapsplan op te stellen. Indien u getrouwd bent, een geregistreerd partnerschap bent aangegaan of samenwoont en het gezamenlijk gezag heeft over uw minderjarige kinderen, bent u op grond van de wet zelfs verplicht een ouderschapsplan op te stellen.
Wat is een ouderschapsplan? Dit is een schriftelijke overeenkomst die ondertekend moet worden door u als ouders. In deze overeenkomst moeten afspraken worden gemaakt over de kinderen. Als ouder heeft u een grote mate van vrijheid over de wijze waarop u het ouderschapsplan opstelt, maar u dient in ieder geval afspraken te maken over de volgende zaken:
- de manier waarop u als ouders de zorg- en opvoedingstaken verdeelt. U moet dan denken aan het verblijf van de kinderen, de tijd die de kinderen met beide ouders doorbrengen (de omgang) en welke taken u als ouders op zich neemt;
- de manier waarop u als ouders elkaar raadpleegt en informeert over belangrijke aangelegenheden, die de kinderen aangaan, zoals school, vermogen en gezondheid;
- de kosten van verzorging en opvoeding van uw kinderen (kinderalimentatie).
Ook moet worden vermeld de wijze waarop u als ouders uw kinderen heeft betrokken bij het opstellen van het ouderschapsplan. Het hangt van de leeftijd van uw kinderen af in welke mate u de kinderen hierin dient te betrekken. Van belang is dat u in ieder geval samen de kinderen uitleg geeft over de afspraken die u heeft gemaakt.
In het verzoekschrift tot echtscheiding dient de advocaat eveneens te vermelden over welke punten u het eens bent geworden en over welke punten niet.
Wat kunt u als ouders doen als u het niet eens kunt worden? Uw advocaat dient in dat geval in het verzoekschrift tot echtscheiding aan te geven waarom u als ouders er niet in bent geslaagd in overleg een ouderschapsplan op te stellen. Een rechter zal in de regel genoegen nemen met een concept echtscheidingsplan dat door één ouder is opgesteld, indien het onmogelijk is gebleken afspraken te maken.
U dient er wel rekening mee te houden dat een rechter u vervolgens naar een bemiddelaar verwijst met als doel om alsnog te proberen afspraken te maken over uw kinderen.
Met de invoering van de Wet bevordering voortgezet ouderschap en zorgvuldige scheiding op 1 maart 2009, waarin het ouderschapsplan is geregeld, wordt bevorderd dat u als ouders nadenkt over de invulling van het ouderschap na de scheiding. U dient hierover goede afspraken te maken om onnodige conflicten in de toekomst te voorkomen. Er wordt vanuit gegaan dat na scheiding het ouderschap wordt voortgezet. U blijft als ouders samen verantwoordelijk voor de verzorging, opvoeding en ontwikkeling van uw kinderen. Beoogd wordt de band tussen de kinderen en beide ouders na scheiding te behouden.
Kortom, u gaat als partners uit elkaar, maar blijft na echtscheiding samen als ouders verantwoordelijk voor uw kinderen. Het ouderschap blijft voortbestaan.
