Meer Mogelijkheden Milieuvergunningsprocedures | Boskamp & Willems Advocaten    By: Samantha Dale
In milieuvergunningprocedures geldt dat, naar aanleiding van een ingediende aanvraag, in eerste instantie een ontwerp-besluit wordt genomen en bekend wordt gemaakt. Dat ontwerp-besluit wordt gedurende zes weken ter inzage gelegd en in die termijn kunnen belanghebbenden die het niet eens zijn met het ontwerp-besluit, een zienswijze indienen. Vervolgens wordt dan een definitief besluit genomen, waarbij ook wordt ingegaan op de zienswijzen. Tegen dat definitieve besluit kan beroep worden ingesteld bij de Raad van State. Tot voor kort gold dat in de beroepsprocedure enkel kon worden geklaagd over aspecten die ook al in de zienswijze zijn genoemd. Werden nieuwe aspecten in beroep aan de orde gesteld, dan leidde dat tot niet-ontvankelijkverklaring, hetgeen er op neerkomt dat de Raad van State zich over die beroepsgrond niet uitspreekt. De hiervoor bedoelde algemene regel is door de Raad van State in een uitspraak van 27 januari 2010 iets bijgesteld. In die uitspraak geeft de Raad van State aan dat de beperking dat in beroep enkel kan worden geklaagd over de aspecten die ook in de zienswijze aan de orde zijn gesteld, beperkt blijft tot “beslissingen over de aanvaardbaarheid van verschillende categorieën milieugevolgen”. Onder verschillende categorieën milieugevolgen wordt o.a. verstaan: geur, geluid, trilling en ammoniakemissie. Voor al die aspecten geldt derhalve nog steeds dat daarover in beroep enkel kan worden geklaagd, indien de aspecten in de zienswijze zijn genoemd. Wordt echter in beroep bijvoorbeeld gesteld dat het verlenen van de milieuvergunning leidt tot strijdigheid met het bestemmingsplan (een mogelijke weigeringsgrond ingevolge artikel 8.10 van de Wet milieubeheer) dan moet de Raad van State zich daarover uitspreken, ook al is dat aspect niet in de zienswijze genoemd. Een ander voorbeeld is dat in het beroepschrift wordt gesteld dat geen revisievergunning had moeten worden verleend, maar een oprichtingsvergunning. Ook dat aspect mag dus voor het eerst in beroep aan de orde worden gesteld. De uitspraak van 27 januari 2010 maakt niet duidelijk of in beroep met succes kan worden geklaagd over bijvoorbeeld strijdigheid met het bestemmingsplan, indien in het geheel geen zienswijze over het ontwerp-besluit is ingediend. Is in het geheel geen zienswijze ingediend en wordt in het beroepschrift enkel geklaagd over strijdigheid met het bestemmingsplan, dan zou mogelijk dat beroep toch ontvankelijk kunnen zijn. Toekomstige rechtspraak zal dat duidelijk moeten maken. Vooralsnog lijkt het er echter op dat het indienen van een zienswijze noodzakelijk is om een ontvankelijk beroepschrift te kunnen indienen.
