Our dynamic society has had various changes in the traditionally known family set up, and various groups have been formed with vested interests on each side of the issue. Same-sex marriage is now legal in the United States following a Supreme Court ruling that struck down state marriage bans. It implies that marriage licenses have to be granted to gay and lesbian couples and all US states have to recognize the marriages that took place in other states. The issue of same-sex marriages is addressed in this paper basing the arguments on two contrasting organizations with different positions on same-sex marriages.
Alliance for Marriage
Alliance for Marriage was founded by Matt Daniels whose offices are in Virginia. The founder’s view on marriage is based on personal experience and claims to protect what he lacked in his life. Alliance for marriage was founded in 1999 as a non-profit organization in the United States (Alliance for Marriage, 2008).
The organization dedicates itself to the promotion of marriage and addressing the rising cases of fatherless families in the United States. AFM is known for the role it played in drafting the proposed Federal Marriage Amendment to the US constitution. The amendment was instrumental in defining marriage in the United States as a union between one man and one woman and was later renamed as the Marriage Protection Amendment though it failed in 2014.
The source of funding is not known, but it calls upon good wishers and interested corporations to donate their support for the work it does. The current total membership is not available on the website, but the most likely persons to be members are the people living without a father and single mothers who were left by their husbands for other women. Married couples comprising of one man one wife are also likely to be active members of the organization. The least likely people to be members are those already in same-sex marriages and the men who are opposed to the proposed marriage amendment that every family should have a father.
American Foundation for Equal Rights
Political consultants co-founded American Foundation for Equal Rights; Chad Griffin and Kristina Schake in 2009. The organization was started in support of the plaintiffs in Hollingsworth V. Perry federal lawsuit that challenged California’s Proposition 8 under the Due Process and Equal Protection clauses of the 14th Amendment to the U.S Constitution (American Foundation for Equal Rights, 2017).
The organization conducts campaigns with a goal of legalizing same-sex marriages from coast to coast. It wants the U.S to attain marriage equality by sponsoring lawsuits that deal with Equal protection clauses of the Fourteenth Amendment to the U.S constitution.
The funding for the organization comes from fundraising activities where donors come into support gay-related issues from Hollywood, Wall Street, Washington, and the corporate world. The donors are Republicans and Democrats, hence is non-partisan. The current membership is not portrayed from the website but has four employees and about 25 volunteers who work for it. The most likely people to be members are the supporters of same-sex marriages, and those least likely to be members are those against any attempts to have same-sex marriages legalized in the U.S.
The key issue addressed by both organizations is the basic setup of a family where one side supports one-man-one wife unions, and the other side pushes for equal rights for all and thus can have same-sex marriages as they wish. As argued by the Alliance for marriage organization, marriage institution should be honored and comprise of a union of a man and a woman who come together to raise a family. On the contrary, the American Foundation for Equal Rights argues that everybody is entitled to equal rights and have a right to marry a person of their choice regardless of their gender. The organization pushes for same-sex marriages to be legalization across all states in the U.S.
The legislation that was passed about the issue is the Defense of Marriage Act that defined marriage as the union of one man and one woman and allowed states to refuse to recognize same-sex marriages. In 2013, Section 3 of the Act was declared unconstitutional in the case of United States v. Windsor in which it was said to have prevented same-sex married couples from being recognized as spouses, and thus, could not receive marriage benefits. For the Due Process Clause of the Fifth Amendment in the case of Obergefell v. Hodges (2015), the U.S Supreme Court declared it unconstitutional by disallowing same-sex marriage be performed under federal jurisdiction (BBC, 2015).
Gender is a key concern in this debate since it revolves around marriages comprising of either same-sex or between a man and a woman. In this case, the gender issue is highly debatable as some people argue that their rights are violated when not allowed to marry the person of the gender they wish. Other people argue that only unions between males and females should be recognized in law.
Currently, the issue of same-sex marriages has attracted a serious debate as to whether it is acceptable or not. There are dozens of organizations that either support or oppose the issue of same-sex marriages. The debate on same-sex marriages is based on the law where some provisions seem to side with the interests of one side of the debate. It is important that a consensus is arrived at on the issue, but the bottom line should be the protection of rights of all the people.
