Marin V., din Iasi: Sunt angajatul unei mari companii si de trei ani nu mi-am efectuat integral concediul de odihna. Seful mi-a spus ca am pierdut zilele de concediu din anii trecuti si mai am dreptul doar la concediu aferent anului 2013. Asa este? Nu ar trebui sa-mi plateasca concediul de odihna neefectuat in anii precedenti? Corneliu Bente, presedintele Uniunii Nationale a Expertilor din Legislatia Muncii Dreptul la concediu de odihna este un drept garantat tuturor salariatilor. Conform art. 144 alin (2) din Codul Muncii, dreptul la concediu de odihna anual nu poate forma obiectul vreunei cesiuni, renuntari sau limitari. Cu alte cuvinte, salariatul nu poate renunta sub nicio forma la zilele sale de concediu de odihna, iar angajatorul este obligat sa-i acorde salariatului intreaga perioada a concediului la care acesta are dreptul legal. Rezulta deci, ca orice cesiune, renuntare sau limitare in acest sens este nula absolut. Codul Muncii mai prevede ca angajatorul este obligat sa acorde concediu, pana la sfarsitul anului urmator, tuturor salariatilor care intr-un an calendaristic nu au efectuat integral concediul de odihna la care aveau dreptul. Angajatorul este obligat ca la sfarsitul fiecarui an sa realizeze o programare a concediilor pentru anul urmator, cu consultarea salariatilor. Evident, este necesara respectarea acestei programari, doar ivirea unor situatii neprevazute si care necesita prezenta salariatului la serviciu ar face ca acesta sa sufere modificare, fara a afecta insa dreptul salariatului de e efectua concediul. Concediul de odihna se poate compensa in bani numai in cazul incetarii contractului individual de munca. Pentru a intari aceasta prevedere, aduc drept argument si Hotararea din 6 aprilie 2006 a Curtii Europene de Justitie, conform careia inlocuirea concediului neefectuat cu o compensatie financiara nu este permisa decat in cazul desfacerii contractului de munca, chiar si in ipoteza in care concediul este reportat intr-un an ulterior. Legea 53/2003 prevede, de asemenea, si in sarcina angajatului, obligatia de a efectua in natura concediul de odihna cu exceptia situatiilor expres prevazute de lege sau atunci cand, din motive obiective, concediul nu poate fi efectuat. In cazul dvs. nu poate fi vorba de o pierdere a dreptului la concediu. Angajatorul avea obligatia de a vi-l acorda pana la finele anului urmator celui in care nu ati efectuat partial sau integral zilele de concediu. Nerespectarea acestei obligatii a angajatorului nu atrage pierderea unui drept garantat de lege salariatului. Solicitati angajatorului sa va acorde in totalitate zilele de concediu de odihna neefectuate in anii anteriori. Daca refuza, va puteti adresa unui expert in legislatia muncii, care va poate ajuta in acest sens.(read entire article)(posted on: 2014-04-18)
