When one invests a substantial amount of hour and attempt in generating something, one should be made alert of the intellectual property preservation that one could avail. Copyright is one such authority that is made accessible to the generator of a genuine literary, dramatic, artistic, or musical work. Such right becomes endowed in the creator as soon as the work is generated. Copyright registration certifies that an author or creator of a work can assert copyright over items varying from software programs to movies, and even executions at times.
But a query that often emerges in the minds of the people is whether or not it is compulsory to register the copyright in a work in India?
The answer is: No, you do not mandatorily require to register your work to be awarded copyright the reason being that the Berne Convention prohibits formalities such as registration as a need to preserve copyright. However, registration of copyright composes at first sight proof in case of copyright infringement.
For whom is Copyright registration most important?
Production houses in India should be made alert that registration ...
... of the copyright in the movies produced by them is an important step in the movie-making process. But, in usual practice, this converts out to be costly and therefore is a stage that most Production houses prefer to skip. Well, what they are unaware of is that in the procedure of creating a small saving, they make a huge deprivation in the course when copyright infringers disclose their movies online even before the exact release date of the film.
Piracy is a difficulty globally and it impacts all the important content industries such as software, television, and movies. Indian courts have preceded various judgments applying the provisions of the copyright law. Section 52A(2) claims that no person shall publish a video film in respect of any work unless the following particulars are exhibited in the video film, when displayed, and on the video cassette or on any other channel:
(a) If such work is a cinematograph film needed to be certified for exhibition under the provisions of the Cinematograph Act, 1952, a copy of the certificate released by the Board of Film Certification under section 5A of that Act in respect of such work;
(b) the name and address of the person who has made the video film and a declaration by him that he has acquired the mandatory license or consent from the owner of the copyright in such work for creating such video film; and
(c) The name and address details of the owner of the copyright in such work.
