How To Start Practicing As An Advocate In India

The procedure of becoming an Advocate In India is double. First, the aspirant must be a holder of an academic degree of Bachelor of Law from a recognized institution in India and second, he/she must get passed the examination of the Bar Council of the state where he/she wants to be enrolled for law practice. For this purpose, the Bar Council of India (BCI) conducts this exam to appraise whether a law graduate possesses the required aptitude to practice law in the country or not. All India Bar Examination (AIBE) started in 2010 when the Legal Education Committee (LEC) and Bar Council of India (BCI) members passed a notification regarding this exam. All India Bar Examination (AIBE) is held twice a year, that is, in February/March and November/December.
Enrollment with a Bar Council of India or any state also means that the law degree holder is acknowledged as a Lawyer and is required to maintain the norms of conduct and professional demeanor at all times, both on and off the profession. The Bar Council of India (BCI) also recommends "Rules of Conduct" to be followed by the Lawyers in the courtrooms, while interacting with clients and even otherwise.
All Advocate In India is on the same level and is recognized as such. Any distinction, if any, is made only on the basis of priority, which signifies the length of practice at the Bar Council. An Advocate may be known by the Judges of the High Court (in case of an Advocate practicing in High Court) or by the Supreme Court (in case of the Advocate practicing in Supreme Court). While the bestowal of Senior Advocate status not only indicate importance and popularity of the Advocate, it also requires the Senior Lawyer to adhere higher standards of conduct and some distinct rules.
Also, a Senior Lawyer is not allowed to interact straight with the clients. He/she can only take briefs from other Lawyers and debate on the basis of the details given by them. From the year 2010 onwards, a compulsory rule is made for advocates passing out from the year 2009-10 to sit for an assessment test named AIBE (All India Bar Examination) for one to qualify as an advocate and practice in the courts. However, to practice Law before the Supreme Court of India, Lawyers must first appear for and qualify in the Supreme Court Advocate on Record Examination conducted by the Supreme Court.
