Being A Custodial Parent

In any child custody battle almost always each parent wants to be the custodial parent. While such a prospect means winning physical custody with your child for the majority of the time, there are other elements that it includes and involves. This article will discuss what being a custodial parent means and the associated responsibilities that come with it.

In the state of New York there are two forms of custody; legal and physical custody. Whichever parent has legal custody he or she has the right to make important decisions about the child’s care such as medical care or religious upbringing. Whichever parent has physical custody he or she is responsible for the actual physical care and supervision of the child. In legal terms the phrase custodial parent refers to “the parent who has physical custody of their child for the majority of the time”. Therefore, the custodial parent carries most of the responsibility of raising the child even though the non-custodial parent may be highly involved or the parents work together as co-parents.

A DeRoberts Law Firm attorney stated that, “there are many benefits that come with being a custodial parent and one of these is having more one-on-one time with your child. This is mainly because as the custodial parent you have the majority of the time with your child. By being the custodial parent it means that you get to see your children regularly, are deeply involved in their day-to-day activities, help with homework, nurture their interests and provide guidance as they face different problems each day”. While being a custodial parent [https://www.quora.com/What-are-custodial-parents-rights] is a great privilege it must be noted that it is a lot of hard work. While it includes enjoying the best days of your children’s lives it also includes being privy to their bad days.

A common question that is asked by parents is whether they will receive child support because they are the custodial parent. In response to this the attorney stated that, “most of the time a custodial parent is eligible to receive child support, however, this depends on the child support guidelines, how much each parent earns and whether or not the parent chooses to file for child support”.

There are a number of responsibilities that come with being the custodial parent some of these responsibilities include the following:

Sticking to a Visitation Schedule

It is important that the custodial parent develop a parenting plan with the non-custodial parent in order to set a visitation schedule. If a court has imposed a visitation schedule the custodial parent should ensure that the schedule is followed. If it is necessary to change the visitation schedule, the custodial parent should give the non-custodial parent as much advance notice as possible.

Consult the Non-Custodial Parent on Important Matters

If there is joint custody of the child it is necessary to consult the other parent on all meaningful issues affecting the child. A parenting plan allows you to discuss how to handle various situations that may arise with your children.

Track Child Support Payments

If you are receiving child support payments ensure that you keep record of such payments. If you need to request back child support payments in court, a proof of payment received can be a requirement.
